It is important to note that unless a specific service explicitly states otherwise in its terms of use, the services offered are not intended to provide any form of financial, real estate, or related advice. Users should be aware that the services may include advertisements, which are tailored to be relevant and useful based on the information collected through the platform. Progressive Business s.r.o. will not be held responsible for any outcome or effect directly or indirectly associated with any action or inaction taken by you or any consumer based on the Services or any other information accessible through or in connection with the Services, unless otherwise specified in your Product’s Terms.
2. To use the Services, you need to be at least 18 years old. By agreeing to these Terms of Use, you affirm that you are at least 18 years old, have not been suspended or removed from the Services previously, and that your registration and use of the Services comply with all applicable laws and regulations. Some features of the Services may require you to register for an account and agree to a Product’s Terms, if applicable, which may be included here or available on a separate ZeroCommHomes site. During the registration process, you will need to provide accurate information about yourself, such as your email address, phone number, or other contact details, and agree to keep this information up to date. You will also be required to create a password, and it is your responsibility to maintain the confidentiality of your account and password, and to ensure that no one else has access to your account. Unless you have a commercial agreement with us allowing you to use the Services for transactions on behalf of another person, you may only use the Services for your own transactions.
3. Use of the Services; Restrictions.
- A. Upon compliance with the Terms of Use, users are granted a non-exclusive, limited, and revocable license to utilize the Services for personal purposes. Real estate or mortgage professionals may also use the Services to provide information to their clients and act on their behalf, known as “Pro Use,” provided that all necessary authorizations and consents have been obtained. Users are not authorized to use, reproduce, distribute, display, or provide access to any part of the Services on third-party websites. Additionally, the Services may not be utilized for commercial real estate transactions, including commercially zoned properties and vacation rentals.
- B. You are allowed to use the content from the Services within the limitations specified in these Terms of Use. You may only copy information without the use of automated processes for personal use or professional use in order to view, save, print, fax, and/or email such information. However, you must obtain our prior written approval before displaying any other ZeroCommHomes’ data.
4. Please keep in mind the following guidelines when using the services:
– Do not reproduce, modify, distribute, display, or provide access to any portion of the Services except as explicitly permitted.
– Do not post links to the Services from a third-party website that is not real estate-related.

– Do not upload viruses, worms, or other harmful software to the Services.
– Do not post illegal, offensive, or objectionable content as deemed by the company.
– Do not interfere with the system integrity or security of the Services.
– Do not conduct automated queries or any other automated activity to obtain information from the Services.
– Do not use the company’s trademarks as part of your screen name or email address.
– Do not access or use the Services to develop competitive products or services.
– Do not encourage any third party to engage in any of the above-mentioned prohibited activities.
5. Regarding fees/subscriptions:
– You may be required to pay fees to access certain features of the Services, and all fees are in U.S. dollars and non-refundable.
– If there are changes to the fees for the Services, the company will provide advance notice of those changes.
– Authorized third-party payment processors will charge the payment method specified at the time of purchase.
– Subscriptions may include features that allow for automatically recurring payments, and these Subscription Services will continue unless and until cancelled.

User Materials:
A. User-Generated Content (UGC) Definition and License Grant:
Certain parts of the Services may allow users to upload or provide images, photos, videos, data, text, listings, and other content (“User Materials”). By uploading or providing User Materials to the Services, you grant us an irrevocable, perpetual, royalty-free worldwide license to use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, prepare derivative works of, incorporate into other works, and translate your User Materials. You also grant us the right to sublicense these rights to the maximum extent permitted by applicable law. We are not obligated to pay you for your User Materials. We may remove or modify your User Materials at any time. You are solely responsible for all User Materials made through your user account(s) on the Services or that you otherwise make available through the Services. For all User Materials, you represent and warrant that you are the creator and owner of the User Materials, or have the necessary licenses, rights, consents, and permissions to authorize us and other users to access and use your User Materials.
B. UGC Disclaimer:
We are not obligated to edit or control your User Materials or the User Materials of any other user and will not be responsible or liable for any User Materials. However, we may screen, remove, edit, or block any User content, including User Materials, if we find it violates these Terms of Use or if we find it otherwise objectionable. You understand and acknowledge that User Materials may be inaccurate, offensive, indecent, or objectionable. By using the Services, you agree to waive any legal or equitable right or remedy you may have against us with respect to User Materials. We expressly disclaim any and all liability in connection with User Materials. If we are notified that User Materials allegedly do not conform with these Terms of Use, we may investigate and determine whether to remove those User Materials at our sole discretion and without notice. For more information on our handling of infringing content, please refer to Section 11 below.
7. The Services contain links to third-party products, services, and websites, as well as content provided by third parties. There is also functionality that allows for the sharing of your User Information with third parties. These third-party providers are solely responsible for their services, and any interactions or business conducted with them are solely between you and the third party. Your use of third-party sites, services, or products may be subject to their terms of use and privacy policies. We do not endorse or take responsibility for these third-party products, services, websites, or materials. By using a tool that allows for User Information to be transferred, you agree to the transfer of your information to third parties. If you indicate interest in contacting a third-party provider, you may receive telemarketing calls from them. We are not responsible for any damages or costs arising from your dealings with these third parties.
As part of the Services, you may be connected with a real estate professional or with a party providing mortgage loan origination services, title and escrow services, or other settlement services. You authorize us to make such referral or lead sale and acknowledge that we may be compensated for facilitating such connections. If these parties have an affiliated relationship with us, we may receive a benefit from the referral between such affiliates.
8. The Services provided by ZeroCommHomes are owned and operated by the company. All aspects of the Services, including user interfaces, design, information, data, code, products, software, and graphics (referred to as “ZeroCommHomes’ Materials”), are protected by intellectual property and other laws and belong to ZeroCommHomes or ZeroCommHomes’ Third-Party licensors. Unless expressly permitted by these Terms of Use, you are not authorized to use the ZeroCommHomes’ Materials, and ZeroCommHomes retain all rights to the ZeroCommHomes’ Materials and Services not explicitly granted in these Terms of Use.
9. Your valuable feedback is important to us. If you decide to offer input or suggestions regarding our services or any related materials, you grant us the right to use this feedback to improve our services or create new products and services.
10. We are committed to upholding the intellectual property rights of others and expect all users of the Services to do the same. If you believe that your copyrighted work has been used on the Services in a way that constitutes copyright infringement, please follow the guidelines outlined in Title 17, United States Code, Section 512(c)(2) and provide the following information:

(ii) Description of the infringing material and its location on the Services to enable our copyright agent to locate it;

11. Deactivation, Deletion, or Changes to Agreement: You have the option to deactivate your account at any time, except as outlined in any Product’s Terms. However, if you choose to deactivate or delete your account, you are still required to settle any outstanding fees incurred before termination, related to your use of the Services. If you violate any provision of these Terms of Use, your authorization to use the Services from ZeroCommHomes will be automatically revoked. Furthermore, we reserve the right to, at our sole discretion, deactivate, suspend, or terminate your access to your account and the Services at any time and for any reason, with or without notice. We also retain the right to modify, suspend, or discontinue the Services or any part of the Services without prior notice. We will not be held responsible for any alterations to the Services or any suspension or termination of your access to, or use of the Services.
We also reserve the right to amend these Terms of Use at any time at our sole discretion, and we will make reasonable efforts to notify you of any significant changes to these Terms of Use. Your continued use of the Services after any updates take effect will indicate your agreement to the revised version of the Terms of Use, and will constitute acceptance of, and agreement to, any such changes. You are committed to protecting, defending, and absolving ZeroCommHomes, our associates, and our respective directors, officers, staff, and representatives from any and all claims and requests brought by any third party due to or arising from: (a) your use of or access to the Services; (b) your violation of these Terms of Use; (c) your infringement of any law or the rights of a third party; (d) any disagreement or matter between you and any third party; (e) any User Materials you submit to, or otherwise provide through, the Services; (f) your deliberate misconduct; and (g) any other party’s use of the Services through your account and password.

Please be aware that the services provided by ZEROCOMMHOMES are offered “as is,” “with all faults,” and “as available.” You assume all risk for the quality, performance, accuracy, and effort of the services. ZEROCOMMHOMES and our suppliers do not make any express or implied representations, warranties, or conditions. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, workmanlike effort, accuracy, title, quiet enjoyment, no encumbrances, no liens, non-infringement, uninterrupted or error-free access or use. Any advice or information obtained through the services or any materials available through the services does not create any warranty regarding ZEROCOMMHOMES entity or the services that is not expressly stated in these terms of use. You assume all risk for any damage that may result from your use of or access to the services, your dealing with any other user, and any materials, including all user and ZEROCOMMHOMES’ materials, available through the services. You understand and agree that your use of the services, and use, access, download, or other obtainment of materials through the services and any associated sites or services, are at your own discretion and risk, and that you are solely responsible for any damage to your property (including your computer system or mobile device used in connection with the services), or the loss of data that results from the use of the services or the download or use of those materials. It’s important to note that some jurisdictions may prohibit a disclaimer of warranties and you may have other rights that vary from jurisdiction to jurisdiction.
15. The ZEROCOMMHOMES shall not be held liable for any indirect, consequential, special, incidental, or punitive damages arising from these Terms of Use or your use of the services, including damages for loss of profits, goodwill, or any other intangible losses. This limitation of liability extends to damages resulting from breach of contract, breach of warranty, negligence, or any other cause of action, regardless of whether the ZEROCOMMHOMES have been advised of the possibility of such damages. The ZEROCOMMHOMES assume no liability for errors, inaccuracies, personal injury, property damage, unauthorized access to secure servers, interruption of transmission, or any bugs, viruses, or the like transmitted through the services. Additionally, the ZEROCOMMHOMES disclaim responsibility for any errors or omissions in the materials or for any loss or damage resulting from the use of any materials made available through the services. Their liability to you for all claims is limited to the amount you have paid to the ZEROCOMMHOMES for the services in the 12 months prior to the events giving rise to the claims. It is important to note that these limitations may not apply in some jurisdictions, and each provision in the terms of use is intended to allocate the risks between the parties. These limitations will apply even if any limited remedy fails its essential purpose.

The Terms of Use are subject to the laws of the State of Washington and any disputes, claims, or actions arising from these terms or the Services must be brought before the state and federal courts in King County, Washington. The Services are operated from offices in Prague, Czech Republic, and it is important to note that we do not guarantee that the Services are suitable or available for use in other locations.
17. General. You are prohibited from exporting any part of the Services or any direct product thereof without compliance with applicable export laws, rules, and regulations, as well as all required licenses and approvals. The U.S. Government’s use of the Services is subject to the commercial license rights described herein. Any changes to these Terms of Use must be made through a written agreement signed by authorized representatives of the parties. If any part of these Terms of Use is found to be invalid or unenforceable, the affected provision will be replaced with a valid and enforceable provision that closely aligns with the original intent, while the rest of the Terms of Use will remain in effect. The section titles in these Terms of Use are used for convenience and have no legal significance. We reserve the right to assign this Agreement, in whole or in part, at any time with or without notice to you. However, you may not assign these Terms of Use or your rights in the Services. Our failure to act upon a breach, or our decision to waive a breach by you or others, does not waive our right to act upon subsequent or similar breaches. Except as expressly stated herein, these Terms of Use and all incorporated terms and agreements constitute the entire agreement between you and ZeroCommHomes regarding the Services, superseding all prior communications.
18. By using our Services, you are giving your consent to receive specific electronic communications from us as outlined in our Privacy Policy. You acknowledge that any electronic notices, agreements, disclosures, surveys, or other communications we send to you satisfy all legal communication requirements, including those regarding written communication.
The Services may include web forms, links, or contact details, such as phone numbers, that allow you to connect with ZeroCommHomes or third parties, such as real estate agents, owners, property managers, and Third-Party Providers. Communications through these channels may be handled by a third-party service (“Communications Service”). Their calls may be recorded or monitored for quality assurance, training, or customer service. You will be informed at the outset of a call if it may be recorded or monitored.

Attention California Residents: If you reside in California, you have the right under California Civil Code Section 1789.3 to contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N.
